Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and your business ("you") and TalkToClient ("we," "us," "TalkToClient"). Please read them carefully before creating an account.


1. Acceptance of Terms

By creating a TalkToClient account, you confirm that you are at least 18 years old, that you have the legal authority to enter into this agreement on behalf of your business, and that you accept these Terms in full. If you do not agree, do not create an account or use our Service.

2. What TalkToClient Does

TalkToClient is an AI-powered virtual receptionist and booking platform. It communicates with your clients over email, SMS text messaging, phone calls, and a website chat widget — answering enquiries, booking appointments, sending reminders, and managing conversations on your behalf, 24 hours a day.

3. Your Account & Responsibilities

You are responsible for:

  • Keeping your login credentials secure and confidential.
  • All activity that occurs under your account.
  • Providing accurate information about your business and keeping your profile reasonably up to date — the AI can only represent your business as well as the information you give it.
  • Monitoring your dashboard regularly for booking activity and client messages.

Notify us immediately at support@talktoclient.com if you suspect any unauthorised access to your account.

4. The Service is Actively Evolving

TalkToClient is under continuous active development. We regularly update our AI models, refine responses, and introduce new features. This means that response quality, feature availability, and service behaviour may change without advance notice. By using TalkToClient, you acknowledge you are using an evolving platform and that occasional imperfections are an inherent part of that.

5. AI Limitations & Disclaimer of Liability

Our AI assistant is designed to communicate with your clients accurately and helpfully. However, AI systems can misunderstand requests, produce incomplete or incorrect responses, make scheduling errors, or miss instructions — even when everything is set up correctly.

TalkToClient is a tool to support your front desk operations, not a replacement for your own judgement and oversight. You remain responsible for reviewing bookings, following up on important communications, and correcting anything the AI gets wrong.

To the fullest extent permitted by applicable law, TalkToClient, its owners, employees, contractors, and affiliates shall not be liable for any loss, missed booking, client dispute, lost revenue, reputational harm, or any other direct, indirect, or consequential damage arising from an incorrect, incomplete, or misunderstood AI response.

6. Third-Party AI Providers

To generate AI replies, TalkToClient transmits relevant parts of your business information and client conversation context to third-party AI providers (currently including Google Gemini and, where configured, xAI Grok or Anthropic Claude). These providers process that data under their own terms of service and privacy policies. Do not include in your business profile or client communications any information you would not want processed by an external AI system.

7. SMS, Voice & Email — Your Clients, Your Responsibility

TalkToClient provides the infrastructure that lets your business text, call, and email your clients. You are solely responsible for:

  • Obtaining and maintaining proper consent from your clients to receive automated messages, calls, and emails through this platform.
  • Complying with all applicable communications laws in your jurisdiction — including, but not limited to, Canada's Anti-Spam Legislation (CASL), the U.S. Telephone Consumer Protection Act (TCPA), and any equivalent regulations that apply to your business.

TalkToClient is not responsible for your compliance with these obligations, and is not liable for any regulatory action, fine, or dispute arising from your communications with your own clients.

8. Free Trial

New accounts receive a free 30-day trial that covers up to 5 clients per month, includes email support and the website chat widget, and requires no credit card to start. Your dashboard shows how many days remain. Trial limitations, included features, and eligibility are subject to change. SMS and voice calling require a paid plan.

9. Subscriptions, Billing & Cancellation

Paid plans are billed monthly in Canadian dollars (CAD) via Stripe, our payment processor. All prices are listed on our pricing page and within your dashboard.

  • You may cancel your subscription at any time. Your access continues until the end of the billing period you have already paid for.
  • We do not offer refunds for partial months or unused time within a billing period.
  • We reserve the right to change plan pricing with at least 30 days' notice sent to the email address on your account.
  • Accounts with outstanding unpaid invoices may be suspended until payment is resolved.

10. Phone Add-On (Voice Calls)

A dedicated phone number for SMS texting is included on all paid plans at no extra cost. Enabling AI voice calls is a separate, optional add-on billed per transcribed exchange (each back-and-forth turn during a phone call) at the rate displayed in your dashboard. There is no flat monthly fee for this add-on — you are only charged for calls that actually take place.

11. Acceptable Use

You agree to use TalkToClient only for lawful, legitimate business purposes. You must not:

  • Use the Service to send spam, unsolicited bulk messages, or harassing communications.
  • Impersonate any person or entity, or misrepresent your business.
  • Use the Service in connection with any fraudulent, deceptive, or illegal activity.
  • Attempt to interfere with, reverse-engineer, or compromise the Service or its underlying infrastructure.

We may suspend or terminate accounts that violate this section, immediately and without prior notice.

12. Your Data & Privacy

We store your business information and client data securely for the sole purpose of operating the Service on your behalf. We do not sell your data to third parties. You retain ownership of all data you upload or generate through your account. Please see our Privacy Policy for full details.

13. Intellectual Property

TalkToClient, including its software, branding, interface, and underlying technology, is owned by or licensed to us. These Terms do not transfer any intellectual property rights in the Service to you. You retain full ownership of your own business content, branding, and client data.

14. Indemnification

You agree to indemnify and hold TalkToClient and its owners, employees, and affiliates harmless from any third-party claim, damage, or legal expense (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your failure to obtain proper consent from your clients for automated communications; or (c) any dispute between you and your own clients.

15. Limitation of Liability

To the maximum extent permitted by applicable law, TalkToClient's total cumulative liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total fees you paid to TalkToClient in the three (3) months immediately preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

16. Termination

We may suspend or terminate your access to TalkToClient if you violate these Terms, engage in abusive behaviour toward our team or systems, fail to pay for a paid plan, or for any other reason we deem necessary to protect the integrity of the Service. You may close your account at any time by contacting us at support@talktoclient.com.

17. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to conflict-of-law principles. If you have a dispute with us, we encourage you to contact us first at support@talktoclient.com — the majority of issues can be resolved directly and promptly.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Service, legal requirements, or business practices. When we do, we will update the "Last updated" date at the top of this document. Your continued use of TalkToClient after any changes are posted constitutes your acceptance of the revised Terms.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TalkToClient and supersede all prior understandings, representations, or agreements relating to the Service.
